March 19, 2014 -- Westchester County District Attorney Janet DiFiore announced that Adrian Stewart (DOB 02/18/86) of 55 Alder Street, Yonkers, New York, was sentenced today to three consecutive terms of one and one third to four years - a total of four to twelve years - in prison on his December 2013 conviction to:

  • two counts of Driving While Intoxicated, with a previous DWI conviction, class “E” Felonies,
  • one count of Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class “E” Felony,
  • two counts of Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, class “A” Misdemeanors,
  • Obscured Front Plate, in violation of the NYS Vehicle and Traffic Law.

On Sept. 23, 2012, at approximately 3:14 a.m., in the vicinity of 431 Van Cortlandt Avenue in Yonkers, members of the Yonkers Police Department responded to a report of an abandoned, white Audi stopped in the middle of the roadway.

Upon arrival, the officers observed a white Audi stopped in a travel lane, with the defendant asleep and reclined in the driver’s seat, with the motor running and in gear. The officers made several attempts to wake the defendant from his sleep.

The officers woke the defendant up, had him attempt various sobriety tests and observed that the defendant had bloodshot, glassy eyes, slurred speech, and detected a strong odor of alcoholic beverage coming from the defendant’s breath.  

The defendant was arrested and transported to the Yonkers Police Department.

A check of the defendant’s driver’s license showed that he had four suspensions, imposed on three distinct dates, for failing to answer summons and/or pay a fine along with a pending DWI case in Harrison.

On Nov. 2, 2012, at approximately 3:21 a.m., in the vicinity of Lamartine and Warburton Avenues in Yonkers, patrolling members of the Yonkers Police Department observed a white Audi motor vehicle with a dark tinted cover obstructing the legibility of the front plate.

An officer approached the vehicle on the driver’s side and requested driver information from the defendant. The officer detected an odor of alcoholic beverage emanating from the defendant and observed the defendant to have glassy, bloodshot eyes and slurred speech. The officer then recovered a non-driver identification from the defendant’s right, rear pocket.  A check of the defendant’s driver’s license showed that he still had the four suspensions, imposed on three distinct dates, for failing to answer summons and/or pay a fine, in addition to the suspension pending prosecution from the previous arrest.

An arrest warrant was issued on Dec. 3, 2013 as the defendant chose not to be present during his trial in December 2013 and was tried in absentia.

He was convicted on Dec. 10, 2013.

An active arrest warrant remains in effect for this defendant.

Assistant District Attorney Nadine Nagler of the Vehicular Crimes Bureau prosecuted the case.
