June 2, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that James Brower (DOB 01/10/82) of 45 Park Avenue, Mount Vernon, New York was convicted on June 1, 2017 after a jury trial conducted by Judge Susan Cacace of:

• one count of Burglary in the Second Degree as a Sexually Motivated Felony, a class “C” Felony,
• one count of Forcible Touching, a class “A” Misdemeanor,
• one count of Stalking in the Third Degree, a class “A” Misdemeanor.

On or about Oct. 12, 2016 at approximately 3 p.m. in the vicinity of West 3^rd Street and South 11^th Avenue in Mount Vernon, Westchester County, the defendant accosted a female victim who was walking to a nearby deli, made sexually charged statements that placed her in fear he would subject her to unwanted contact. 

When the victim attempted to ignore the defendant and continue on her way, the defendant followed the victim, repeated his sexual advance and forcibly slapped her buttocks.  Fearful that defendant would follow through on his continued threats of sexual advances, the victim fled to the safety of her home where she reported the assault to her husband.

During her disclosures, the homeowners were startled to discover the defendant had pursued the victim into their home and threshold of her bedroom. Upon seeing the victim’s husband, however, the defendant fled the scene with the husband in pursuit who also called 911. The defendant was apprehended shortly thereafter by members of the Mount Vernon Police Department, who responded quickly and efficiently to the homeowners call for aid.

He will be sentenced on Aug. 15, 2017.

The defendant, as a second violent felony offender, faces up to 15 years in state prison and 20 years post-release supervision.
