June 10, 2014 -- Westchester County District Attorney Janet DiFiore announced that Mario Garcia-Sura (DOB 07/20/64) of 77 Locust Hill Avenue, Yonkers, New York was sentenced today to an indeterminate term of five to fifteen years in prison on his April, 2014 guilty plea to:

  • one count of Aggravated Vehicular Homicide, a class “B” Felony,
  • one count of Driving While Intoxicated, an Unclassified Misdemeanor under the New York State Vehicle and Traffic Law.

On Oct. 20, 2013, the defendant was operating his 2001 black Ford Mustang convertible along Riverdale Avenue in Yonkers. He had a front seat passenger with him.

The two men had met earlier in the day in a local deli and during the course of the afternoon began to drink together and drove around in the defendant’s Mustang visiting neighborhood bodegas drinking beers.

At about 5:13 p.m., Garcia-Sura drove his Mustang down Riverdale Avenue at a high rate of speed and at the intersection of Riverdale Avenue and Franklin Avenue collided with a 2004 gold Hyundai Sonata operated by the 19-year-old victim Sreeraj Chandran.

The victim was taken to St. Joseph’s Hospital where he was pronounced dead at approximately 6:12 p.m.

The defendant’s passenger was taken to Jacobi Medical Center where he was admitted for severe injuries to his lower body.

Assistant District Attorney Kristina Dushaj, of the Superior Court Trail Division, prosecuted the case.
