July 25, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Augustus Moore of the Bronx and Madisyn Pettaway of Jersey City, NJ, have been indicted on a multicount indictment for burglary, robbery and weapons charges. Moore was arraigned today before Westchester County Court Judge Susan Cacace. The arrest of Pettaway is pending.

The two were indicted by a Westchester County Grand Jury on the following:

  • Two counts of Robbery in the First Degree, class B felonies
  • Two counts of Burglary in the First Degree, class B felonies
  • Two counts of Robbery in the Second Degree, class C felonies
  • Burglary in the Second Degree, class C felony
  • Grand Larceny in the Third Degree, class D felony (value at more than $3,000)

Separately, Moore is charged with Criminal Possession of a Weapon in the Third Degree, a class D felony, and Pettaway is charged with Criminal Possession of a Weapon in the Fourth Degree, a misdemeanor.

Background
On Jan. 18, 2018, the victim was in his home in New Rochelle with co-defendant Madisyn Pettaway, a woman he had been dating for six months or so. At approximately 4:55 a.m., Pettaway, unbeknownst to victim, let Augustus Moore and two other individuals into the apartment. At the same time, Pettaway left the apartment and entered a car parked outside the building. Moore went into the victim's bedroom, pointed a firearm at him, and told him to get face down on the bed. The victim complied and his mouth was taped shut and his arms and legs were tied up with tape and clothing. While on the bed, the victim heard the individuals ransacking his apartment. 

Moore and the other two individuals left the apartment after approximately 25 minutes and joined Pettaway in the car parked on the street and drove away. Meantime, the victim was able to free himself from being tied up, walked through his apartment and noticed jewelry, money, clothing and electronics missing, including his cellphone. He went out to the street, found a pedestrian and asked that person to call 911. Police responded and the investigation began.

Moore was arrested May 7, 2018, by New Rochelle Police.

Judge Cacace set bail at $75,000 cash or $50,000 bond. Moore is expected back in court Aug. 8, 2018.

Assistant District Attorney Jonathan Strongin of the Superior Court Trial Division is prosecuting the case.
