Defendant: John Labarbera (DOB 05/03/68)

July 12, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that John Labarbera of Poughquag, NY, in Dutchess County, was sentenced to one year in county jail and restitution for stealing from a Westchester car dealership where he worked. He pleaded guilty to a charge of Grand Larceny in the 2nd Degree in February before Westchester County Court Judge Barry Warhit.

Labarbera provided an additional $5,658.63 today for a total of $115,658.63. A Judgment and Order of Restitution for the remaining amount of $115,658.63 was signed by the court. The total value of the larceny is $231,317.26. 

Labarbera was employed as the Parts Manager for the Curry Acura dealership on Central Park Avenue in the Town of Greenburgh. According to the charges, from approximately May 5, 2011 through March 5, 2015, Labarbera stole parts from the dealership and sold them for profit. 

Labarbera perpetrated his scheme by convincing management of the dealership to sell automobile parts through the online auction site eBay.com. With the consent of the dealership, he then set up an account to sell parts on behalf of the dealership. Using this valid account as cover, and without management’s knowledge, Labarbera set up a separate eBay account which he used to sell parts he stole from the dealership. Over the course of almost four years, Labarbera would steal automobile parts, sell them on eBay, ship the parts to his buyers via Curry Acura's FedEx Ground account, accept payments via PayPal, and keep the money for himself. He manipulated the inventory and accounting system of the dealership to cover up his crimes.

Assistant District Attorney Berit Huseby of the Economic Crimes Bureau prosecuted the case.
