  • one count of Criminal Sexual Act in the Third Degree, a class “E”” Felony,

On July 28, 2015 at approximately 6:12 pm at Bedford Hills Correctional Facility located at 247 Harris Rd., Town of Bedford, County of Westchester, State of New York, the defendant Rasheen Smalls, while on duty at the facility as a corrections officer, entered a utility closet of one of the housing units with the victim and engaged in oral sexual conduct with her.

The defendant was remanded to the Westchester County Jail in Valhalla.

He is due to be sentenced on August 10, 2016.

The defendant faces an indeterminate sentence of imprisonment of between one-and-a-half to four years in state prison.

Assistant District Attorney Laura Murphy, Sex Crimes Bureau Chief, prosecuted the case.
