July 15, 2013 -- Westchester County District Attorney Janet DiFiore announced that Jonathan Wallace (DOB 05/26/80) of 3081 Webster Avenue, Bronx, New York, was sentenced today to 12 years in prison and 20 years post release supervision on his Oct. 2013 conviction after a jury trial to:

  • one count of Attempted Criminal Sexual Act in the First Degree, a class “C” Felony,
  • one count of Rape in the Third Degree, a class “E” Felony,
  • one count of Unlawful Imprisonment in the Second Degree, a class “A” Misdemeanor.

On April 29, 2012, at approximately 4:30 a.m., the defendant, a purported operator of a “gypsy” cab, picked up the victim in the area of East 241st in the Bronx.

Instead of taking the victim to her residence, he took her to the vicinity of South 14th Avenue and West 3rd Street in Mount Vernon and stopped the car.

The defendant then demanded money from the victim, claimed she was a prostitute and began to slap and then sexually assault her.  

The victim was finally able to flee, immediately reporting the assault to Mount Vernon Police and was treated at Mount Vernon Hospital.

The defendant’s identity was determined when his DNA profile, which was in CODIS, the national DNA index system, as a result of a previous felony conviction, was linked forensically to evidence in this case.

The defendant was subsequently arrested by the New York City Police on an unrelated gun charge.

Mount Vernon detectives questioned the defendant who was then arrested for rape and related sex offenses.

Assistant District Attorney Michelle Lopez, Deputy Chief of the Sex Crimes Bureau, prosecuted the case.
