July 31, 2013 -- Westchester County District Attorney Janet DiFiore announced that Anthony Fontaine (DOB 09/12/57) of 2 Consulate Drive, Tuckahoe, New York, was sentenced today to 3 ½ years in prison on his guilty plea to:

  • one count of Attempted Rape in the First Degree, a Class “C” Violent Felony.

The defendant was employed as a driver and resident counselor at the Hawthorne Foundation/ Ossining IRA, a residential group home for mentally disabled adults in Ossining, New York.

The defendant admitted that on December 24, 2011, he attempted to force the female victim, a resident of the facility, to have sex.

The victim told one of her attendants what happened, and an investigation began by the Westchester County Police assisted by the Sex Crimes Bureau of the District Attorney’s Office.

The investigation continued over a period of six months.

The defendant was arrested by the Westchester County Police Warrant Squad on June 13, 2012 and an indictment was unsealed at that time.

As the case progressed, a negotiated disposition in full satisfaction of all charges was agreed to in order to spare this vulnerable victim the trauma of reliving the defendant’s sexual assaults at trial.

On March 20, 2013, the defendant entered a guilty plea to a single charge, and his guilty plea was reaffirmed in court prior to sentencing today.

The defendant was sentenced to 3 ½ years in state prison with 10 years post-release supervision. He will be required to register as a sex offender prior to his release.
