July 3, 2013 -- Westchester County District Attorney Janet DiFiore announced that Mark Bernardini DOB (03/17/56) of 955 Peach Lake Road, North Salem, New York was arraigned today on a Felony Complaint charging him with:

  • one count of Criminal Sexual Act in the First Degree, a class “B” Violent Felony.

On July 2, 2013, at his office located at 27 Milburn Street in Bronxville, the defendant, a Licensed Clinical Social Worker (LCSW), engaged in sexual contact with a 12-year-old boy that he was counseling.

The victim immediately cried out to his family after the session and they immediately contacted the Bronxville police.

The defendant was arrested early this morning by the Bronxville police.

Bail was set at $75,000 cash or $150,000 bond.

The defendant’s next court date is July 17, 2013.

He faces a maximum sentence of twenty five years in state prison on that charge.

Assistant District Attorney Amy Puerto of the Special Prosecutions Division is prosecuting the Criminal Sexual Act case.

In addition, the defendant has a pending Forcible Touching case – a class “A” Misdemeanor - in North Salem, stemming from a May 16, 2013 incident, in which he touched a 16-year-old girl that he was counseling at his home.

His next court date in that case is July 15, 2013.

He faces a maximum sentence of one year in County Jail on that charge.

Assistant District Attorney Joyce Miller of the Sex Crimes Bureau is prosecuting that case.
