Jan. 26, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Wayne Brown DOB (08/14/75) of St. Mark's Place, Mount Kisco, New York was sentenced today to seven years in state prison after a jury trial in which he was found guilty of:

  • two counts of Criminal Possession of a Controlled Substance in the Third Degree, class "B" Felonies,
  • one count of Criminal Possession of a Controlled Substance in the Fifth Degree, a class "D" Felony,
  • one count of Criminally Using Drug Paraphernalia in the Second Degree, a class "A" Misdemeanor,

relating to the possession of cocaine.

On Feb, 25, 2015, after a two-month investigation by officers from the Westchester County Police and the Northern Westchester Drug Task Force involving extensive surveillance, search warrants were executed on the defendant, his car and his basement apartment at St. Mark's Place in Mount Kisco.

Three ziplock plastic bags containing more than 500 milligrams of cocaine secreted in a black balloon on the defendant's lap were seized when he was arrested in his car at the ShopRite parking lot on Bedford Road in the Town Of Bedford.

When police subsequently executed the search warrant for his St. Mark's Place home, they discovered over an ounce of cocaine beneath a shelving area in the basement, which was worth approximately $5,000.

They also found 1,000 empty glassine envelopes, meant for packaging cocaine for street sale, as well as $5,273 in cash. Westchester County Police utilized a K-9 to aid in the search; and were assisted by officers from the Northern Westchester Drug Task Force.

In addition, an investigator from the Westchester Intel Center procured a Facebook image that proved to be a critical in link in the drug seizure.

Assistant District Attorney Mary Ann Liebowitz and Assistant District Attorney Joseph Barca of the Narcotics Bureau prosecuted the case.
