Jan. 24, 2013 -- Westchester County District Attorney Janet DiFiore announced that Victor Hernandez (DOB 10/31/85) of 1070 Fox Street, Bronx, New York was sentenced today to a determinate term of 8 ½ years in state prison on his November 2012 guilty plea to:

•    one count of Robbery in the First Degree, a class “B” Violent Felony,

relating to a 2009 home invasion robbery in the Town of Greenburgh.

On Dec. 20, 2009 the defendant, who was armed with a knife, along with two unidentified accomplices, forced their way into a house in Greenburgh and proceeded to tie up the husband and wife who were home at the time.

The men stole a number of items from the home: cash, jewelry, flat screen TV and a laptop computer.

The Greenburgh police were notified and an investigation began.

After an extensive investigation involving the Greenburgh Police Department and the Organized Crime and Criminal Enterprise Bureau of the District Attorney’s Office, the stolen laptop was ultimately located – almost two years later - in the Bronx.

The couple’s son, an IT manager, had previously installed software that allowed him to remotely access the laptop when it was powered on.

Evidently the defendant gave the laptop to his girlfriend who continued to use it, unaware of its origin.

Photos downloaded by the son remotely from the stolen laptop included several photos of the defendant, who was identified in April of 2011.

Greenburgh Police went to the Bronx location and learned that the defendant was in jail in Michigan on unrelated burglary charges.

In the intervening time between the Greenburgh home invasion (2009) and the defendant’s identification and indictment in Westchester (2012), the defendant was also incarcerated in Indiana for burglary and deported in September of 2011.

The defendant returned to this country illegally sometime in December of 2011 when he was picked up again.

A warrant for his arrest was issued on Jan. 23, 2012.

The defendant waived extradition from Michigan back to New York and was arraigned in Westchester County on May 9, 2012 after the indictment was unsealed.

Hernandez entered a guilty plea on Nov. 27, 2012.

Upon completion of his sentence, he will be turned over to Immigration and Customs Enforcement who has a detainer on him.

Assistant District Attorney Livia Rodriguez of the Organized Crime and Criminal Enterprise Bureau prosecuted the case.
