Jan. 10, 2013 -- Westchester County District Attorney Janet DiFiore announced that Melchiced Vilchis-Rosas
(DOB 10/12/69) of 34 Fairmont Avenue, Yonkers, New York was arraigned today on a nine count indictment charging him with:
• three counts of Reckless Endangerment in the First Degree, class “D” Felonies,
• two counts of Criminal Possession of a Weapon in the Fourth Degree, class “A” Misdemeanors,
• three counts of Menacing in the Second Degree, class “A” Misdemeanors,
• one count of Criminal Mischief in the Fourth Degree, a class “A” Misdemeanor.
On August 29, 2012 at approximately 10:40 pm, the defendant walked into the Montezuma Restaurant at 350 South Broadway in Yonkers with a black plastic bag that contained an auto loading rifle.
He sat at the bar and then went to the men’s room.
When the defendant emerged from the men’s room, he pointed the weapon at a bar patron.
The bar owner and another patron were able to wrestle the gun out of his hands.
During the scuffle however, the gun discharged a single shot which went through a wall into the women’s restroom.
No one was injured.
The defendant then fled the bar, leaving behind the gun.
Yonkers Police were notified and responded to the scene.
They began a canvass of the area and the defendant was located shortly after the incident and placed under arrest.
Vilchis-Rosas was remanded.
The next court date is January 31, 2013.
Following his arraignment, District Attorney Janet DiFiore said, “This defendant walked into a crowded bar carrying a loaded rifle and with his irresponsible and reckless behavior, placed lives in danger. The quick-thinking actions of the patrons to disarm him and response by police certainly averted what could have been a far more tragic outcome.”
The defendant faces a maximum sentence of 7 years in state prison.
Assistant District Attorney Daniel Flecha of the Superior Court Trial Division is prosecuting the case.
