Feb. 16, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that Errol Hillary (DOB 12/30/76) of 3041 Holland Ave., Bronx, NY was arraigned on an indictment today before Judge Barry Warhit and charged with:
- one count of Murder in the Second Degree, a class “A-1” Felony,
- five counts of Attempted Murder in the Second Degree, class “B” Felonies,
- four counts of Assault in the First Degree, class “B” Felonies,
- one count of Assault in the Second Degree, a class “B” Felony,
- one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Felony
in the death of O’Neil Bandoo and the shooting and serious wounding of five other men.
On Dec. 25, 2016 at approximately 2:50 a.m., the defendant entered “The Mansion”, a night club located at 4 North 3rd St. in Mount Vernon where a Christmas party was being held.
While inside the club, the defendant became agitated and began to cause a disturbance. When security asked him to leave, the defendant began to fight with two members of the security team.
Security attempted to forcibly remove the defendant by dragging him to the front door.
O’Neil Bandoo, the owner of the club, was standing outside with another man, a friend of the defendant, when they heard the commotion.
The two men entered the club and asked the defendant to comply with security and leave. That is when the defendant walked towards the front door of the club, grabbed a 9mm firearm from his person and began shooting back into the hallway from the threshold of the door.
He shot O’Neil Bandoo one time in the chest killing him. He shot and seriously wounded five others who were in the hallway at the time, some of whom suffered multiple gun shot wounds.
The defendant then attempted to run away at which point he was tackled to the ground in front of the club. During the struggle, the defendant dropped his gun. He was able to break free at which point two other members of the club’s security detail tackled the defendant preventing him from grabbing the gun back.
The defendant again managed to break free and run. He was chased by Mount Vernon police officers who placed him under arrest.
The defendant pled not guilty.
He remains remanded.
He faces twenty-five years to life in state prison on the Second Degree Murder charge and twenty five-years on each of the Attempted Murder and Assault in the First Degree charges. He faces fifteen years for Criminal Possession of a Weapon in the Second Degree.
His next court date is Feb. 28, 2017.
This case is being prosecuted by Assistant District Attorney Lana Hochheiser, Deputy Chief, Career Criminal Bureau.
