Aug. 10, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Rasheen Smalls (DOB 08/07/81) of 650 Warburton Ave., Yonkers, NY, was sentenced today to one to three years in state prison after having been found guilty by

a jury on July 1, 2016 of:

• one count of Criminal Sexual Act in the Third Degree, a class “E”” Felony,
• one count of Official Misconduct, a class “A” Misdemeanor.

On July 28, 2015 at approximately 6:12 p.m. at Bedford Hills Correctional Facility located at 247 Harris Rd., Town of Bedford, County of Westchester, State of New York, the defendant Rasheen Smalls, while on duty at the facility as a corrections officer, entered a utility closet of one of the housing units with the victim and engaged in oral sexual conduct with her.

The defendant engaged in this misconduct purely for his own personal satisfaction and abused his authority and position as a New York State Corrections Officer. 

The oral sexual conduct occurred at a time when the victim was incapable of consent by virtue of her being an inmate committed to the care and custody of the New York State Department of Corrections and Community Supervision. 

The defendant has received training from the Department of Corrections and Community Supervision on the inappropriateness, illegality and avoidance of personal relationships with inmates and the illegality of officers engaging in sexual activity with inmates committed to the care and custody of the New York State Department of Corrections and Community Supervision.

Smalls will also have to register as a sex offender.

The defendant was remanded to the custody of the New York State Department of Corrections.
