April 21, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Pedro Delacruz (DOB 02/15/90) of 70 Hawthorne Avenue, Yonkers, New York was found guilty after a jury trial on April 20, 2016 of the following charges:

• one count of Murder in the Second Degree, a class “A” Felony,
• one count of Criminal Possession of a Weapon in the Second Degree, a class “B” Felony

in the shooting death of Victor Fitzgerald.

On July 21, 2013 at approximately 12:37 p.m., the Yonkers Police Department received multiple calls of gunshots being fired behind 80 Riverdale Ave. along with reports of a male down in the parking lot located behind the building.

Responding officers found the victim lying there unresponsive. He was taken to St. Joseph’s Hospital where he was pronounced dead shortly after his arrival.

After an intensive investigation conducted by the Yonkers Police Department and the Westchester County District Attorney’s Office it was determined that the defendant approached the victim on a walkway between 80 and 100 Riverdale Ave. in Yonkers and shot the victim twice, striking him in the chest and the lower back. The victim died from internal injuries and massive bleeding. Both the defendant and the victim had been involved in a long running dispute.

The defendant was indicted by a Grand Jury on Aug. 20, 2015. He was subsequently arrested by Westchester County Police on a warrant five days later.

The defendant is remanded at the Westchester County Jail.

He is due to be sentenced on May 25, 2016.

The defendant faces an indeterminate sentence of imprisonment, the minimum term may be not less than 15 years nor more than 25 years. Thus, the least sentence is 15 years to life, and the greatest sentence is 25 years to life.

Senior Assistant District Attorney Heide Mason and Assistant District Attorney Nicholas DiCostanzo of the Superior Court Trial Division prosecuted the case.
